Auto Accident FAQ


Q: What Should I do after an auto accident?

Make sure that you are in a safe location such as a shoulder of the road or out of traffic completely. If you or anyone in your vehicle is injured, call 911 immediately to get treatment by emergency medical professionals. If you can, try to get as much information as possible about the other driver and vehicle as it will help you in your claim later.

Q: Should I release my medical records to another driver’s insurance adjuster?

A: No. Your medical records should only be signed under limited circumstances, and after consulting with David H. Harris, Jr. Your medical information can hurt your case if it is provided to an insurance adjuster.


Q:What if I don’t feel injured after an auto accident?

A: Still visit a doctor that you trust as you could be suffering from a nonvisual injury such as whiplash, concussion, TMJ, or traumatic brain injury that could seriously disable you.


Q: Can I afford to hire a lawyer after a car accident?

Q: What If I think I caused the accident?

A: After an accident you are most likely going to be in a state of shock, so take the time you need to think clearly about what happened. If an investigation decides that you caused the wreck, your insurance may cover it.

Q:What are your rights as a worker?

A: Although never ideal, accidents can happen while working. If you happen to be the victim of a work related injury, its best to know your rights as a worker. In Illinois, injured workers can receive a variety of benefits which or provided under the Workers’ Compensation Act.


There are three types of benefits available to a worker injured during employment:

1.Reasonable and necessary medical care.

2.Weekly payment for the time the worker is temporarily totally disabled.

3.Compensation for any permanent disability the worker may suffer.


Q: What is Worker’s compensation?

A: Illinois’ Workers’ Compensation Law came into effect in the 1900’s to help protect injured workers from the medical costs and decreased income that occurs from an injury sustained at work.


Q: What Should I do after my injury?

A: Firstly, give notice to your employer of the incident both verbally and in writing. Make sure to include exactly how the incident occurred and the injuries received from the incident. Under the Workers’ Compensation Act you are given 45 days to notify your employer, but will have a much stronger case if you can provide it within 24 hours of the incident occurring.


Secondly, Visit a doctor that you trust to assess your injuries and provide adequate care. Be sure to tell your doctor exactly what happened and address all injuries, as your doctor can help you in your workers’ compensation claim later.
